Division Of Property

 

Illinois law requires the equitable division of property and debts.  A number of factors are taken into consideration in the division of same.  Some of the factors are whether or not the property or debt was acquired prior to the marriage, if the property was inherited, what each party has in non-marital assets, etc.  The division of property includes real estate, personalty, bank accounts, pension plans and any investments that were made with marital funds, which are generally funds that were earned during the marriage.

Attorney's Fees - In some situations, a Court may order the other party to pay his or her attorney's fees.  No one can depend on the Court ordering these fees, as they are within the Court's discretion.  My office generally requires that the retainer fee be paid up front with the client to be reimbursed if the Court orders the other side to pay attorney's fees.
